Collaboration Agreement Ceatrips LLC & Julia
Between: Creatrips LLC, a limited liability company registered in the United States, with its legal address at 30 North Gould Street, Sheridan, Wyoming, 82801, United States (hereinafter, “Creatrips”), and Julia (hereinafter, “the Host”), the following Collaboration Agreement is entered into to regulate the Host’s participation in the organization and leadership of a group trip managed by Creatrips.
1. PURPOSE OF THE AGREEMENT
The purpose of this Agreement is to establish the terms of collaboration between Creatrips LLC and the Host for the promotion, sale, and hosting of group trips (hereinafter, “the Trips”) organized by local tour operators approved by Creatrips.
Creatrips acts as an intermediary and coordinator, managing the planning, communication, and sale of the trip in collaboration with the respective operators, who are responsible for the on-site logistical execution.
For trips in China, the on-site logistical execution is carried out through our registered local operator: Shanghai Tiancheng International Travel Service Co., Ltd.
2. RESPONSIBILITIES OF THE HOST
The Host agrees to:
- Actively promote the Trip within their community and personal channels (social media, newsletters, etc.) with the goal of reaching the minimum number of required bookings (10 confirmed travelers). This includes interacting with potential travelers, answering inquiries, or, when unsure, forwarding questions to Creatrips for proper handling.
- Attend and accompany the group throughout the entire duration of the Trip, actively participating in activities and ensuring a positive and safe experience for all travelers. This includes attending informational meetings hosted by Creatrips and participating in the pre-trip meeting with confirmed travelers.
- Collaborate with Creatrips in pre-trip communication by sharing promotional materials, updates, and required confirmations.
Maintain professional, respectful, and collaborative conduct at all times, representing Creatrips’ values.
- Provide advance notice if they need to partially or fully excuse themselves from the Trip.
- Comply with deadlines for submitting personal information and flight details, as specified in this Agreement.
- Follow local, cultural, and safety regulations in all destinations visited.
- Be present throughout the Trip to accompany travelers during scheduled activities.
- Actively participate in leading the Trip, ensuring adherence to the itinerary and the quality of the traveler experience.
- Supervise the progress of the Trip and traveler satisfaction, making adjustments when necessary.
- Foster integration and mutual respect among travelers, ensuring a harmonious environment for the duration of the Trip.
- Respect the authority of the trip coordinator, who will handle problem-solving and traveler safety.
RESPONSIBILITIES OF CREATRIPS
Creatrips agrees to:
- Provide the Host with an itinerary managed and executed by a tour operator approved by Creatrips.
- Process traveler payments and manage bookings.
- Handle communication with travelers once a reservation is confirmed.
- Ensure that the local operator provides a tour leader or representative to assist the Host and the group during the Trip.
- Provide promotional materials and operational support before and during the Trip.
3. HOST COMPENSATION
The Host will receive a 15% commission on the final sale price for each traveler who is fully confirmed and has paid in full.
Creatrips will process the corresponding payment within 7–10 business days after the Trip concludes.
Payments may be issued via Wise or bank transfer to a U.S. account. For hosts that live in China, Alipay and local bank transfers payment are also available. In that case, we will be able to proceed with these payment methods if the host can provide an official fapiao.
If the Host cannot use the provided payment methods, alternative options may be evaluated on a case-by-case basis, but associated fees will be the responsibility of the Host.
After the Trip ends, Creatrips will provide a detailed earnings breakdown based on the final package price and the number of confirmed travelers.
Covered expenses during the Trip
During the Trip, the Host will have the same included services as the travelers, according to the official itinerary: accommodations, internal transportation, meals, entrance fees, and programmed activities.
In this particular case, considering the family-oriented nature of the trip, the expenses of the Host, her children, and one additional accompanying adult (such as a parent or in-law) will be covered.
4. ADDITIONAL SERVICES
5. ESTIMATED EARNINGS BREAKDOWN (BASED ON SALE PRICE)
| Final sale price |
Host commission |
Earnings per traveler |
Estimated total (10 travelers) | Estimated total(15 travelers) | Estimated total(20 travelers) |
| 3,990 | 15% | 598.5 | 5,985 | 8,977.5 | 11,970 |
| 4,390 | 15% | 658.5 | 6,585 | 9,877.5 | 13,170 |
These rates apply to the original sale price of the Trip and are calculated in USD. If payment is done in RMB, we will apply the currency exchange rate available at the day of making the payment.
6. NUMBER OF TRAVELERS
The Trip requires a minimum of 10 confirmed travelers.
The Trip will not be confirmed, and no payment will be made to the Host unless the minimum is reached no later than 90 days prior to departure.
The maximum number of travelers is 25, unless the Host requests an extension.
7. TRIP INCLUSIONS
The following items are included in the trip and are considered part of the base package:
-
All activities, experiences, and entrance fees listed in the itinerary, including cultural classes, city tours, landmark visits, and shows.
-
Airport pick-up and drop-off.
-
4-star accommodations in double rooms (extra beds provided as needed for children).
-
High-speed train from Beijing to Shanghai.
-
All meals explicitly listed in the itinerary.
-
English-speaking tour guide and group coordinator.
-
Private transportation with air conditioning.
-
Scheduled Chinese classes and cultural workshops.
8. OPERATIONAL DEADLINES
- Trip confirmation: The Host has until 90 days before departure to secure the minimum of 10 bookings. If the minimum is not reached, the Trip may be automatically canceled.
- Sales deadline: The Host has until 90 days before departure to complete the maximum number of bookings, unless an exceptional case is considered individually.
- Submission of personal data: The Host must provide their personal details no later than 90 days before departure.
- Submission of flight details: The Host must provide their flight information no later than 15 days before departure.
9. TRAVELER PAYMENTS
To secure a spot, the traveler must pay a deposit of USD 800 at the time of booking.
The remaining balance may be paid in up to two additional installments, with the full amount due no later than 90 days prior to departure.
For travelers booking within 90 days before departure, 100% of the total cost is due at the time of booking.
10. ITINERARY CHANGES
Creatrips or the operating company reserves the right to make reasonable modifications to the itinerary, hotels, or activities in cases of force majeure, weather conditions, government regulations, or other causes beyond their control. These modifications will not constitute grounds for refunds, provided the core experience of the Trip is maintained.
11. CANCELLATIONS
11.1 By Travelers
Unless otherwise specified in the Trip program, the following penalties apply:
Pending Trip (Not Confirmed)
If the Trip does not reach the minimum of 10 participants 90 days prior to departure and Creatrips must cancel it, 100% of payments made—including the deposit—will be refunded, or credit toward a future trip may be offered.
Confirmed Trip – Cancellation more than 90 days prior to departure
If the traveler cancels more than 90 days before departure, the USD 800 deposit is non-refundable. Any additional payments will be refunded.
Cancellation within 90 days of departure or no-show
Beginning 90 days prior to the Trip, no refunds will be issued, as all services will have been committed.
11.2 By the Host
(a) If the Host withdraws before any bookings are made, no penalties will apply. If the Trip fails to reach the minimum and is canceled, no commission will be generated, as the Trip will not take place.
(b) If the Host withdraws when the Trip has fewer than 10 active bookings, the Trip will be automatically canceled, and all travelers will receive a full refund.
(c) If the Host withdraws after the Trip has been confirmed, the Trip will proceed with a coordinator appointed by Creatrips.
In this case, the Host’s commission will be reduced from 15% to 5% of the final sale price per confirmed traveler, as compensation for the sales generated but without the leadership and hosting component. The remaining 10% will be forfeited, as active participation in the Trip is considered an essential part of total Host compensation.
If the Trip originally had two Hosts and only one participates, the Trip will proceed as planned, with no changes to budget or commission.
(d) If the Host cancels the Trip without justified cause before its start, they may forfeit their entire commission, unless Creatrips grants an exemption due to force majeure or documented illness.
11.3 Force Majeure
The determination of a force majeure event and any operational adjustments to the Trip will be at the discretion of Creatrips and/or the approved local tour operator. Creatrips will not be liable for any failure, delay, or modification in the performance of this Agreement due to circumstances beyond its reasonable control, including but not limited to:
(a) Natural disasters such as floods, fires, earthquakes, storms, droughts, wildfires, or other natural catastrophes;
(b) Pandemics, epidemics, health emergencies, or public safety emergencies declared by relevant authorities;
(c) War, invasion, hostilities, terrorist threats or acts, civil or social unrest;
(d) Laws, decrees, orders, or other governmental actions;
(e) Embargoes, blockades, or restrictions enacted before or after this Agreement;
(f) National or regional emergencies;
(g) Strikes, labor stoppages, or industrial disruptions;
(h) Shortages of energy, transportation, or critical infrastructure;
(i) Any other event beyond the reasonable control of Creatrips or its associated operators.
If the Trip must be canceled due to force majeure, Creatrips will attempt to recover funds paid to suppliers. However, full or partial refunds are not guaranteed, as they depend on supplier policies. Creatrips will not assume losses resulting from events beyond its control.
Each traveler must have international travel insurance covering medical emergencies, trip cancellation, and trip interruption, valid from the start to the end of the itinerary.
If funds are recovered, the amounts actually obtained will be refunded to the traveler or, if preferred, applied as credit for future trips.
11.4 Cancellation by Creatrips for Other Reasons
In the event that Creatrips cancels the Trip for reasons other than insufficient registrations or force majeure, all payments made by travelers will be fully refunded.
In such a case, the Host will not be entitled to any commission, as commissions are payable only for Trips that are effectively operated.
Creatrips will notify the Host and all travelers as soon as reasonably possible in the event of such a cancellation.
12. COMMUNICATION AND TRAVELER MANAGEMENT
(a) Communication with travelers
Creatrips will communicate with travelers before, during, and after the trip, including responding to inquiries submitted through the trip page form, managing payments, requesting necessary personal information, sending reminders, informational materials, and coordinating logistics. At the end of the trip, Creatrips will send travelers an evaluation email to gather feedback regarding the overall experience, logistics, and the Host’s performance. At no point will Creatrips send travelers promotions for other trips or information not strictly related to the purposes of their trip. Reservation management will be carried out through the WeTravel platform, from which all reservation-related communication will be sent.
(b) Ongoing collaboration
Creatrips and the Host will maintain constant communication before, during, and after the trip to ensure a smooth and safe experience for travelers. The Host agrees to remain available and respond within a reasonable time to requests from the Creatrips team.
13. DOCUMENTATION AND HEALTH REQUIREMENTS
All travelers, including the Host, must possess a passport valid for at least six months from the date of entry into the destination country. If required, travelers must also obtain the necessary visas, vaccinations, and permits. The processing and acquisition of these documents are the sole responsibility of each traveler and of the Host.
Creatrips reserves the right to exclude from the Trip any individual whose medical condition may pose a risk to themselves or to the group. Both the Host and the travelers are responsible for ensuring that they are physically and medically fit to participate in this Trip.
If the Host or travelers have celiac disease or any type of allergy, Creatrips will make every reasonable effort to accommodate individual needs; however, there is an inherent risk of cross-contamination.
Due to the nature of the trips organized by Creatrips, they are not recommended for individuals with reduced mobility.
14. TRAVEL INSURANCE
Both the Host and all travelers must purchase international travel insurance that covers medical emergencies, force majeure cancellation, lost luggage, and medical evacuation. Creatrips will request a copy of the insurance policy prior to the Trip. Failure to provide proof of insurance may result in the cancellation of participation without refund.
15. LIABILITY AND CONDUCT
Creatrips acts as an organizer and coordinator between the Host, the travelers, and local providers. The Host is expected to maintain respectful, professional, and collaborative conduct throughout the entire Trip. Any inappropriate behavior—including discrimination, violence, abuse, excessive alcohol consumption, violation of local laws or regulations, harassment, or failure to comply with rules that may endanger the group—may result in immediate termination of this Agreement and complete forfeiture of the Host’s commission.
16. USE OF IMAGES AND CONTENT
The Host may use the Creatrips name and logo exclusively for the promotion of the agreed Trip. All content shared must appropriately represent the values of the brand.
Creatrips may use images, videos, and materials generated during the Trip for promotional purposes. The Host may request in writing the exclusion of specific images.
17. DIGITAL CONDUCT AND ONLINE BEHAVIOR
The Host must maintain professional and respectful conduct both during the Trip and on their social media platforms. The Host may not publish content that is offensive, discriminatory, or damaging to the reputation of Creatrips or its local partners. Any violation may result in suspension of the collaboration and loss of commission.
18. INDEPENDENT CONTRACTOR STATUS
The Host acts as an independent contractor. This Agreement does not constitute an employment relationship, partnership, or agency between the parties. The Host does not have the authority to assume financial or legal obligations on behalf of Creatrips.
19. RISK ACKNOWLEDGMENT AND LIABILITY WAIVER
The Host acknowledges that the trips organized by Creatrips may involve unpredictable risks, including injury, illness, accidents, or property damage, even in situations where Creatrips and its local operators act with due diligence.
The Host understands that destination conditions may vary and that Creatrips will make every effort to ensure group safety but cannot guarantee circumstances beyond its control.
The Host agrees to follow all local safety guidelines and all Creatrips policies during the Trip. Creatrips is not responsible for negligence or misconduct by third parties.
The Host confirms being over 18 years of age and having read and understood this Agreement.
ACCEPTANCE
Both parties declare that they have read, understood, and accepted the contents of this Agreement, signing digitally or physically as a sign of consent.
