Terms and Conditions for Hosts

Between: Creatrips LLC, a limited liability company registered in the United States, with its principal office at 30 North Gould Street, Sheridan, Wyoming, 82801, United States (“Creatrips”), and the Host, the following Collaboration Agreement is entered into, which governs the participation of the Host in the organization and leadership of a group trip managed by Creatrips.

PURPOSE OF THE AGREEMENT

This agreement establishes the terms of collaboration between Creatrips LLC and the Host for the promotion, marketing, and accompaniment of group trips (hereinafter, the “Trips”) organized by local tour operators approved by Creatrips.

HOST RESPONSIBILITIES

The Host agrees to:

This includes interacting with prospective participants, answering inquiries, or, if answers are not available, forwarding questions to Creatrips for proper management.

– Provide the Host with an itinerary managed and executed by an approved tour partner.

– Process traveler payments and manage reservations.

– Handle communication with travelers once reservations are confirmed.

– Ensure the local operator provides a tour leader or representative to assist the Host and the group during the trip.

– Provide promotional materials and operational support before and during the trip.

HOST COMPENSATION

The Host will receive a 15% commission on the final sale price per confirmed traveler who has completed payment.

Creatrips will process payment within 7 to 10 business days after the trip concludes.

Payments may be made via Wise or bank transfer to a U.S. account. If these methods are unavailable, individual cases will be evaluated, but commissions will remain the responsibility of the Host.

Upon trip completion, Creatrips will provide a detailed earnings breakdown based on the final package price and the number of confirmed travelers.

Expenses Covered During the Trip

The Host will receive the same services included for travelers according to the official itinerary: accommodation, local transportation, meals, entry fees, and scheduled activities.

International flights and personal expenses or optional activities outside the itinerary are not included.

PROMOTIONAL DISCOUNTS

The Host may, at their discretion, offer a maximum discount of USD 200 on the final sale price, valid for up to 30 days after the official trip launch or until the first 10 bookings are completed, whichever occurs first.

Any additional discount requires prior written authorization from Creatrips.

Commission will be calculated on the net total actually received by Creatrips.

ADDITIONAL SERVICES

(a) Additional services booked by travelers before the trip begins are commissionable at 10%. These may include extra nights of accommodation, airport transfers, hotel upgrades, optional activities, or any service not included in the base itinerary.

(b) These services will be invoiced separately by Creatrips and managed directly with the travelers.

(c) Additional services booked during the trip are not commissionable.

NUMBER OF TRAVELERS

The trip requires a minimum of 10 confirmed travelers.

The trip will not be confirmed, and no payment will be made to the Host unless the minimum is reached at least 90 days before departure.

The maximum number of travelers is 25, unless the Host requests an extension.

OPERATIONAL DEADLINES

Trip Confirmation: The Host has up to 90 days before departure to reach the minimum of 10 bookings. If not met, the trip may be automatically canceled.

Sales Closure: The Host has up to 90 days before departure to complete the maximum number of bookings, except in special cases handled individually.

Submission of Personal Data: The Host must submit personal information at least 90 days before departure.

Flight Information Submission: Flight details must be provided at least 15 days before departure.

TRAVELER PAYMENTS

To secure their place, travelers must pay a deposit of USD 800 at the time of booking.
The remaining balance may be paid in up to two additional installments, so that the total is fully paid 90 days before departure.
In exceptional cases where travelers book within 90 days of departure, 100% of the total amount must be paid at booking.

ITINERARY MODIFICATIONS

Creatrips or the tour operator reserves the right to make reasonable modifications to the itinerary, hotels, or activities in case of force majeure, weather conditions, government directives, or other causes beyond its control. Such modifications will not result in refunds, as long as the essence of the trip is maintained.

CANCELLATIONS

By Travelers

In the event of a traveler cancellation, the following penalties will apply, unless the program specifies different conditions:

Pending Trip (Not Confirmed)
If the trip does not reach the minimum of 10 participants 90 days prior to the departure date and Creatrips must cancel it, 100% of payments made, including the deposit, will be refunded, or a credit may be offered for a future trip.

Confirmed Trip – Cancellation More than 90 Days Before Departure
If the traveler cancels their participation more than 90 days before departure, the $800 USD deposit is non-refundable. Any additional payments made will be refunded.

Cancellation Within 90 Days of Departure or No-Show
From 90 days prior to the start of the trip, no refunds will be issued, as all services will have been committed.

By the Host

(a) If the Host cancels before any reservations are made, no penalties will apply.

If the trip does not reach the minimum number of participants and must be canceled, no commission will be generated, as the trip will not have taken place.

(b) If the Host cancels when the trip has fewer than 10 active reservations, the trip will be automatically canceled, and all payments to travelers will be refunded.

(c) If the Host cancels after the trip has been confirmed, the trip will still take place with a coordinator assigned by Creatrips in charge of the group.

In this case, the Host’s commission will be reduced from 15% to 5% of the final sale price per confirmed traveler, as compensation for the sales already made, but excluding the leadership or accompaniment component.

The remaining 10% of the commission will be forfeited, as the Host’s active participation is an essential part of total compensation.

If the trip originally had two Hosts and only one participates, the trip will proceed as planned without modifications to budget or commissions.

(d) If the Host cancels the trip without justified cause and before its start, they may lose their entire commission, unless Creatrips considers a force majeure exemption or documented illness applicable.

Force Majeure Cancellations

The determination of a force majeure event and any operational modifications to the trip are at the discretion of Creatrips and/or the approved local tour operator.

Creatrips will not be liable to the Host for any breach, delay, or modification in executing this agreement due to circumstances beyond reasonable control, including, but not limited to, the following force majeure events:

(a) Acts of nature, such as floods, fires, earthquakes, storms, droughts, wildfires, or other natural disasters
(b) Pandemics, epidemics, or public health/safety emergencies declared by competent authorities
(c) War, invasion, hostilities, threats, terrorist acts, civil or social unrest
(d) Laws, decrees, orders, or other government actions
(e) Embargoes, blockades, or other restrictions in effect or enacted after the date of this agreement
(f) National or regional emergencies
(g) Strikes, labor stoppages, or interruptions in industrial activity
(h) Shortages of energy, transport, or critical infrastructure
(i) Any other event beyond the reasonable control of Creatrips or its associated operators

If the trip must be canceled due to force majeure, Creatrips will make efforts to recover funds paid to suppliers. However, full or partial refunds are not guaranteed, as this depends on each supplier’s policies and conditions.

In such cases, Creatrips will not assume losses arising from circumstances beyond its control.

Each traveler must have international travel insurance covering medical emergencies, trip cancellation, and trip interruption, valid from the start date to the completion of the itinerary.

If funds are recovered, the amounts obtained will be returned to the traveler, or, if preferred by the traveler, applied as credit for future trips.
